Terms of Service

1. Agreement

These Terms of Service (“Terms”) govern your use of hsgcustommerch.com and any purchase from HSG Custom Merch, a trade name of Haven Solutions Group LLC, a New Mexico limited liability company (“we,” “us,” “our”). By using this site or placing an order, you agree to these Terms, our Return and Refund Policy, our Shipping Policy, and our Privacy Policy, which are incorporated by reference. If you do not agree, do not use the site or place an order.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. A minor may place an order only with the involvement and consent of a parent or guardian.

3. Orders and Acceptance

An order is an offer to purchase. We accept your order when we confirm your artwork, print size, and placement with you and begin production. We may decline or cancel any order, in whole or in part, before production begins, including for unavailable materials, suspected fraud, pricing or listing errors, or artwork that does not comply with Section 7. If we decline or cancel, we will refund any amount you paid for the affected items.

4. Prices, Taxes, and Payment

Prices are in U.S. dollars and include the print or engraving shown, unless the listing states otherwise. Applicable taxes and shipping charges are calculated at checkout. If a product is listed at an incorrect price because of an error, we may cancel the order and refund you, even after you receive an order confirmation. Payment is due in full at checkout.

5. Custom Orders

Your content. You are responsible for the content of your order, including artwork, text, spelling, and the names you enter for personalization. We print personalization exactly as you type it.
Artwork review. We review submitted artwork and confirm print size and placement with you before production. We may adjust size or placement to fit the product and will tell you about any material change before production.
Variation. Colors may differ from how they appear on your screen. Placement may vary by up to 1/2 inch. Product images, including manufacturer images, are representative.
Product availability. Blank garments and items come from third-party suppliers. If an item becomes unavailable, we will offer a substitute or a refund for that item.

6. Your Artwork and License to Us

You represent and warrant that:

(a) you own, or have written permission to use, all artwork, logos, text, images, and other content you submit (“Your Content”); and
(b) Your Content and our reproduction of it as you request do not infringe any copyright, trademark, right of publicity, or other right of any person, and do not violate any law.

You keep ownership of Your Content. You grant us a non-exclusive, royalty-free license to use, reproduce, resize, and modify Your Content only as needed to produce, fulfill, and support your order, and to keep it on file for reorders. We will not display Your Content in our marketing without your permission.

7. Content We Will Not Produce

We may refuse any artwork, at our sole discretion, including content that:

(a) uses a trademark, logo, character, or copyrighted work you are not authorized to use, including names, logos, seals, and insignia of sports teams, schools, companies, and branches of the U.S. Armed Forces;
(b) is obscene, hateful, harassing, threatening, or defamatory; or
(c) promotes illegal activity or violates any law.

If we refuse your artwork, we will refund any amount you paid for the affected items.

8. Returns, Cancellations, and Our Quality Promise

Custom products are final sale. Cancellations, defects, and errors are handled under our Return and Refund Policy.

9. Shipping and Risk of Loss

Title and risk of loss pass to you when we deliver your order to the carrier. Items damaged in transit remain covered by our Quality Promise. Delivery dates are estimates. See our Shipping Policy.

10. Warranties

Our Quality Promise in the Return and Refund Policy is our only express warranty. To the extent permitted by law, we make no other express warranties. Nothing in these Terms limits any warranty or right that applicable law does not allow us to limit.

11. Limitation of Liability

To the extent permitted by law:

(a) our total liability for any claim arising out of or relating to an order is limited to the amount you paid for that order; and
(b) we are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or event-related costs from a delayed delivery.

These limits do not apply to liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Haven Solutions Group LLC and its members, employees, and contractors from any claim, demand, loss, or expense, including reasonable attorneys’ fees, arising from:

(a) Your Content;
(b) your breach of these Terms; or
(c) your violation of any law or the rights of any third party.

13. Site Content

Except for Your Content and third-party marks, the content of this site, including text, graphics, and the HSG Custom Merch name and logo, belongs to us or our licensors. You may not copy or use it without our written permission.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of law rules. Before filing a claim, you agree to contact us at olujan@hsgcustommerch.com and give us 30 days to resolve the dispute informally. Any claim not resolved informally must be brought in the state courts located in Sandoval County, New Mexico, except that either party may bring an individual claim in small claims court where it qualifies.

15. Changes to These Terms

We may update these Terms by posting a revised version on this site with a new “Last updated” date. The Terms in effect when you place an order apply to that order.

16. General

Severability: if any provision is found unenforceable, the remaining provisions stay in effect.
No waiver: our failure to enforce a provision is not a waiver.
Entire agreement: these Terms and the policies they incorporate are the entire agreement between you and us about their subject matter.
